Question One (1000 words)

Critically evaluate the validity of the following dispositions by will:

a. “I give three of my cases of vintage wine in my cellar to my daughters Matilda and Ophelia, Matilda to choose whichever one she wishes and the other two to Ophelia”;

b. “I give 100 of my first class preference shares in Boom Speakers Ltd to my friend Michael”;

c. “I leave the residue of my estate to Tom and Tina as trustees to use the interest to provide a reasonable income for our uncle Joe during his retirement and on his death to such one or more of the fans of the Spice Boys as they shall choose, but in default of appointment the residue is to go to Cumin absolutely.”;

d. “£10,000 to Meena in total confidence that she will do what is best as between my children, in relation to this money”;

e. “To distribute £100,000 amongst the directors and employees of LiverBird Ltd and any of their friends who have contributed to work of LiverBird Ltd”;

distributed as my trustees consider best”;

c. “A legacy of £25,000 to build and maintain in perpetuity a statue of the Earl of
Birkenhead to be located outside the magnificent St.George’s Hall, Liverpool”;

d. “A legacy of £50,000 provide for a free school specialising in science on the
Wirral”;

e. “A legacy of £1m to provide for suitable accommodation for a closed order of
Christian Nuns located in Merseyside”;

f. “A legacy of £500,000 “to preserve British farming and to promote access to
farms for the children of Greater London.”
